Recently government released a notification that Linking Aadhaar card with PAN card is compulsory for all. But there are few people who are exempted from linking Aadhar card with PAN card. Read below the details of people who are exempt from linking Aadhar card with PAN card.
PAN Card & Aadhaar Card
PAN is a 10-digit alphanumeric number allotted by the IT department to individuals and entities and, Aadhaar is a biometric authentication issued by the Unique Identification Authority of India (UIDAI). Aadhaar card has been issued to 111 crore people and there are over 25 crore PAN holders in the country.
List of People who are Exempt from Linking the two cards
Aadhar card and PAN card linking was declared compulsory by July 1st, but not everyone needs to do it. Certain class of people is exempted from linking Aadhar card with PAN card. Here, is the list of people who are exempt from linking the two cards under certain conditions.
Under Section 139AA of income tax act compulsory linking of Aadhar card with PAN card is not applicable to following people.
- People who are not a citizen of India.
- Linking of Aadhar card with PAN card is not applicable to people who are 80 years or more at any time during the tax year.
- Those who are categorized as non resident Indians as per Income Tax Laws.
- Residents of the states of Assam, Meghalaya and Jammu and Kashmir.
These people are exempted from linking Aadhar card with PAN card from the purview of section 139AA only if, they do not possess Aadhar enrollment number. Section 139AA of the Income Tax states that, all those who will be allotted PAN card after July 1st, 2017 and obtain Aadhar card shall intimate the same to the tax authorities. Those who do not link the PAN card with Aadhar card, will end up making their PAN cards invalid.
By making the link of two cards compulsory, Government wants to eliminate those people who hold multiple PAN cards or fake PAN cards. Whether the individuals file tax returns or not, he/she must link his/her Aadhar card with PAN card. Central Board of Direct Taxes (CBDT) has made an announcement that those who do not wish to obtain Aadhar card and do not have Aadhar card , will have an exemption from their PAN card being cancelled.?
